Reasons

The landlord attended the hearing by telephone.
The tenant appointed an agent in writing on 18 November 2025. On 2 February 2026 the agent advised the Tribunal that neither she nor the tenant would be attending the hearing and that the tenant was not to be contacted “under any circumstances”.
The hearing therefore proceeded in the tenant’s absence and in accordance with her wishes.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy. Rent arrears
The tenancy ended on 4 September 2025. The landlord provided rent records which prove the amount owing at the end of the tenancy. Claim for compensation
The landlord provided photographic evidence that the tenant had left behind he at the premises a substantial quantity of loose bricks. Some of the bricks had been used to form borders around small areas but many were piled up.
The tenant claimed that the landlord had given her permission to build raised gardens with the bricks.
The landlord gave evidence that the tenant was given permission to create a garden at the front of the premises, not at the rear, and that the tenant was expected and told to remove all the bricks at the end of the tenancy.
The landlord explained that the tenant had put down a form of sheeting or weed suppressant underneath the many areas bordered by bricks and that the grass had therefore died. The grass under the large piles of bricks had also died. The landlord advised that these areas required levelling and resowing with grass.
The tenant has an obligation to return the property to the same condition it was in at the start of the tenancy. The damage caused to the landlord is intentional damage and the landlord is entitled to the costs claimed for the removal of the bricks and for the repair of the areas which were damaged.
The amount claimed is reasonable given the quantity of bricks and the damage caused. Filing fee
