The hearing proceeded by way of telephone conference. Ms Francis, Property Manager, appeared for the landlord. Unsuccessful attempts were made to join the tenant to the hearing by telephone. The Tribunal was informed the tenant had been remanded in custody. No agent appeared and no alternative contact telephone number was provided by the tenant to facilitate participation in the hearing. The Tribunal was satisfied the tenant was properly served with the notice of hearing and the case proceeded in their absence.

The tenancy commenced on 1 June 2025 with the fixed term ending on 1 November 2025.

On 18 September 2025 the landlord filed an application seeking termination of the tenancy for rent arrears, outstanding water rates, cleaning costs, refund of the bond and reimbursement of the filing fee.

At the hearing the landlord withdrew their claim for compensation for cleaning costs. The landlord intends to file a further application with the Tribunal once they have possession of the property and a clear picture of all outstanding costs is known.
