Reasons
- The landlord attended the hearing which was held by teleconference on 21 January 2026. The tenant did not attend. Attempts to contact the tenant at the time of the hearing were unsuccessful. I was satisfied that the tenant had been adequately served with notice of the hearing and that it was reasonable to proceed in the tenant’s absence.
- The landlord has applied for termination of the tenancy for breach of the tenant’s obligations, rent arrears, unpaid water charges, compensation for wall damage, refund of the bond and reimbursement of the filing fee.
Should the tenancy be terminated?
- Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy. See sections 55 and 56(2) Residential Tenancies Act 1986.
- Rent is at least 21 days in arrears at the hearing date. The tenancy is terminated.
How much does the tenant owe?
- The landlord provided a rent summary, water invoices, photographs of the damage to the wall, and an invoice for repair costs.
- I was satisfied that the landlord proved rent arrears of $3,200 as at 24 January 2026. I was also satisfied that the landlord proved unpaid water charges of $135.76.
- In relation to the wall damage, the photographs and invoice provided supported the landlord’s claim that the damage occurred during the tenancy and required repair. I was satisfied that the claimed amount of $340.18 was reasonable and that the landlord was entitled to compensation for that damage.
- As the landlord has wholly succeeded with the claim, I must order the tenant to reimburse the filing fee. Adjournment and updated rent summary
- At the hearing, the matter was briefly adjourned to allow the landlord to provide an updated rent summary. That rent summary was provided later on 21 January 2026 and confirmed the rent arrears claimed.
- Due to an administrative oversight, the written decision and orders were not issued at that time. This decision now formally records and gives effect to the determinations made at the hearing.
- The delay in issuing the written decision does not affect the substantive determinations made on 21 January 2026.
