The hearing was conducted via teleconference.

Ms Perese attended the hearing on behalf of the landlord.

Mr Pukepuke-Ahitapu did not attend the hearing. I attempted to contact him on the cell phone number ending in 2909, but was unsuccessful. I was advised that Mr Pukepuke-Ahitapu may have moved to Australia.

I therefore proceeded with the hearing in Mr Pukepuke-Ahitapu’s absence.

The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986 (“RTA”). A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 20 August 2025, the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises.

An inspection on 20 August 2025 confirmed that Mr Pukepuke-Ahitapu, had removed most of his belongings from the property. The inspection photos show that the premises were largely empty, with only a bed, a couch, and a fridge remaining. Curtains were drawn, mail had accumulated, and there was no evidence of occupation.

Ms Perese submits that 20 August 2025 is the date on which she reasonably believed the premises were abandoned. This assessment followed an earlier unsuccessful visit on 13 August 2025, during which a neighbour advised that the tenant had moved to Australia.

A 14-day notice was issued on 21 August 2025, and follow-up visits on 4 September and 15 September confirmed that the property remained in the same condition, with no sign of Mr Pukepuke-Ahitapu and the notice still in the mailbox.

The last rent payment was received on 12 August 2025, and the outstanding rent arrears as of 11 September 2025 total $349.57, calculated for 21 days from the date of abandonment in accordance with section 61(3) RTA.

Ms Perese relies on the evidence filed, including inspection reports, rent summary, photographs, and communication records, to support that Mr Pukepuke-Ahitapu has abandoned the tenancy and that termination is justified

Based on the evidence before me, I am satisfied that the premises have been abandoned and that rent is in arrears. Accordingly, the tenancy is terminated effective immediately.

The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered includes rent in lieu of notice. Filing fee

Because Kāinga Ora–Homes And Communities has wholly succeeded with the application, I must reimburse the filing fee.
