- Section 40(2)(a) of the Residential Tenancies Act 1986 bars a tenant from causing intentional or careless damage. The exit inspection photographs show holes in the walls and doors extensively throughout the property, and that several panes of glass were broken.
- Due to the extensive nature of the damage, I am satisfied that the damage was intentional, and that the tenant is liable for the entirety of the cost. These amounts are awarded.
Is the tenant liable for the cleaning and rubbish removal costs?
- Section 40(1)(e)(iii) requires a tenant, at the conclusion of a tenancy, to leave the premises in a reasonably clean and tidy state and to remove all rubbish. The exit inspection photographs establish that the tenant was in breach of this obligation and that the property was well short of the required standard. On this basis, the cleaning and rubbish removal costs are awarded. The filing fee:
