The applicant attend the hearing by phone. The respondent did not answer.
The applicant advises that this was a fixed-term tenancy due to end in June 2026. They state that in June 2025 the respondent informed them that they could no longer afford the rent and would be moving out. The respondent subsequently vacated the property.
The applicant attempted to mitigate their loss by re-tenanting the property. A new tenant was secured on 22 September 2025. The applicant seeks rent arrears of $5,200 up to 21 September 2025. Rent records have been provided showing the amounts owing to that date. I am satisfied that these records are accurate, and rent arrears are awarded.
The applicant also states that they attempted to re-tenant the property for a period of approximately three months but were unsuccessful at the original rent and were required to reduce the rent. The respondent had been paying $700.00 per week, and the new tenant pays $660.00 per week. The applicant seeks compensation for the $40 weekly difference for the remainder of the fixed term, totalling $1,588.57.
When parties enter into a fixed-term tenancy, both parties receive a level of security, knowing that the tenancy will continue until the end of the term, and both are bound by the obligations arising under that agreement. I am satisfied that the applicant made reasonable efforts to re-tenant the property at the same rent and to mitigate their losses, but was unable to do so. The respondent is therefore liable for the rent shortfall, and the amount sought is awarded.
The applicant also seeks $253.00 for cleaning. Photographs have been provided showing some cleaning towels left at the property. However, there is no evidence that the premises were not left in a reasonably clean and tidy condition. Accordingly, this claim is dismissed.
The applicant further seeks compensation for the costs of re-tenanting the property, including advertising costs, credit and background checks for prospective tenants, mileage costs for travel to and from the property, and an hourly rate for conducting and facilitating inspections.
