[The tenant/s] must pay current rent and the debt as follows: a. By 16 weekly payments of $213.00, being $193.00 for current rent and $20.00 for the debt. b. A final payment of $204.29, being $193.00 for rent and $11.29 for the debt. c. Payments will be every Tuesday, with the first payment on 09/12/2025 and continuing until 31/03/2026.

Ms Leota attended the hearing on behalf of the landlord.

The tenant, Ms Goodman, also attended the hearing.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

On 22 November 2025, the tenant paid a lump sum of $2,544.00 to clear her rent arrears. As a result of this payment, the rent arrears were reduced to $303.29 as of today.

During the hearing, the tenant said that she could pay the amount due, including this week’s rent, between 2 December 2025 and 8 December 2025, and that she would pay $386.00 today. The tenant did not object to a conditional order being issued, as she said she intended to pay off her arrears today.

I am therefore satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986. Filing fee

Because Kāinga Ora–Homes And Communities has wholly succeeded with the claim I must reimburse the filing fee. Name suppression

Kāinga Ora–Homes And Communities has left the issue of name suppression for the tenant to me. I understand why Kāinga Ora–Homes And Communities wishes to support name suppression for the tenant.

However, no proper grounds have been advanced that would persuade me to grant name suppression in favour of the tenant.

On the contrary, it is in the public interest that the tenant’s name be published.

Accordingly, I decline to grant a suppression order in favour of the tenant.
