- The tenancy ended on 14 August 2025. The landlord provided rent records which prove the amount owing at the end of the tenancy - $114.29.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The landlord claims the cost of cleaning the carpet, the cost of deoderising the hallway carpet and the cost of replacing the carpet.
- The tenant had a cat at the property, and for a short period of time she had two cats. She advised that her cat only urinated in one spot by the entry door.
- However, I accept the carpet cleaning report which indicates that although the carpet was cleaned in an effort to get rid of the marks and smell, the smell of cat urine could not be removed.
- I also accept the landlord’s evidence that the Body Corporate required the owner to deoderise the hallway floor because other tenants complained of the smell permeating the hallway.
- The tenant did not leave the premises reasonably clean and therefore is required to pay these costs to the landlord.
- I also accept that cleaning did not get rid of the smell and so the carpet required replacement.
- I have ordered the tenant to pay a depreciated amount for the replacement carpet because the carpet was already 7 years old. A landlord ought to be returned to the position they would have been in had the tenant not breached their obligations. They should not be made better or worse off.
- The landlord also claims the cost of rubbish removal.
- The tenant accepted that she ought to pay the claimed cost of rubbish removal because she had left the premises in a mess. Filing fee reimbursement
- I am also ordering the tenant to reimburse the filing fee to the landlord because the landlord was substantially successful with the claim against her. C ter Haar 27 January 2026
