Reasons

Both parties attended the hearing, conducted via teleconference. Ms Chaney was on a train when called. During the preliminaries the call dropped off. A later attempt to call again went to voicemail. I was satisfied adequate service had completed and I continued with the hearing after the second call also went unanswered.
The landlord has applied for rent arrears and compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
After the completion of the hearing, but before this order was issued, an email to the Registry was received from the tenant confirming her being cutoff.

How much is owed for rent?

The tenancy ended on 1 September 2025. The landlord provided rent records which prove the amount owing at the end of the tenancy is as ordered.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not remove all rubbish. The landlord provided photos of abandoned items and rubbish that required disposal. The supporting invoices for related costs of $866.17 are accepted.
The curtains were missing from the premises at the end of the tenancy. The entry photos confirm their existence at commencement and the exit photos their absence at that time. The landlord replaced them at a cost of $594.13 and sought depreciated compensation of $148.00. The evidence establishes tenant liability and the compensation of $148.00 is awarded.
The amounts ordered are proved.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
The carpet was badly damaged during the tenancy. Pre and post tenancy photos clearly evidence this. The landlord replaced the carpet at a cost of $1,352.78 and sought compensation at a depreciated total of $969.00. The depreciation applied reflected the different ages (between 2 to 6 years) of the carpet on a room-by-room basis.
The amounts ordered are proved.
I have accepted the depreciation schedule as adopted by the landlord as fair. The landlord should be returned to the position they would have been in had the tenant not breached their obligations, and should not be better or worse off.
