Ms Matagialofi Kalapu is the mother of Ms Tracey Kalapu. According to the landlord’s application, the tenants share a cell phone number. Ms Tracey Kalapu informed me that she would advise her mother of the outcome of today’s hearing.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

Ms Kalapu acknowledged the rent and water arrears and stated that she did not wish to lose the tenancy. She advised that she is currently employed full-time and is due to commence a second job the following week. Her mother is also employed full-time, while her father receives a benefit.

Ms Kalapu mentioned that the family’s financial position has recently stabilised, and now that she and her mother are both working, they can cover their ongoing rent and repay the arrears. She suggested paying a higher weekly amount to clear the arrears.

I am satisfied the tenants will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
