I am declining to award the additional $40.00 per week as the tenancy ended by agreement. There was no contract between the parties that if the rent was lesser than what was being paid under the fixed term tenancy, that the tenant would pay the difference.
A contract is formed when both parties decide to exchange something of value, creating an obligation to perform a particular duty which is legally enforceable. The terms of the contract define the rights and obligations of the parties. The landlords claim for the top up rent is declined.
