The hearing was scheduled to be held via video conference.
Ms Barlow attended the hearing.
Ms Barlow advised that approximately half an hour before the hearing, one of the tenants, Ms Halatanu, had emailed her stating that she could not find the link for the video conference. Ms Barlow resent the link, but Ms Halatanu later replied that it was not working.
Ms Barlow further explained that both tenants had disconnected their mobile phones and could only be contacted by email. She said she had previously tried to reach them through Ms Halatanu’s mother, who is another of her tenants, but had otherwise been unable to contact them by phone.
I attempted to call both mobile numbers listed on the application, but neither was answered and no messages could be left. I explained to Ms Barlow that, while I made attempts to contact the tenants, the obligation was ultimately on them to ensure their attendance and participation in the hearing once they were aware of it. Given that they knew of the hearing and failed to attend by video or phone, or to make arrangements to be contacted by phone.
Accordingly, I proceeded to continue the hearing in their absence.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
