Should the tenancy be terminated?
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records and water rates records which prove the amounts owing at the end of the tenancy. The parties have agreed to the 18 January 2026 being the final day of the tenancy. New tenants are moving into the premise on 19 January 2026.
- The tenant has agreed to repay the debt at $520.00 each week until the debt has been repaid in full, as set out in Orders 4 and 5 above. Reimbursement of the filing fee
- Section 102(4) of the RTA confirms that applicants that are wholly or substantially successful in proving their claims will have their filing fee reimbursed.
- Because Auckland Property Management Limited has wholly succeeded with the claim I must reimburse the filing fee.
