Reasons
- The landlord attended the hearing which was held by videoconference. Of the tenants, Mr Coleman attended. The others could not be reached on the numbers given in the Notice of Hearing, which was properly served.
- The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
How much is owed for rent?
- During the tenancy, Ms Kuklinski left without prior arrangement.
- To make the rent more affordable for the remaining tenants, the rent was reduced from $570.00 to $380.00.
- The rent fell into areas and the parties agreed to the tenancy ending on 21 January 2026.
- Mr Coleman continued to pay his agreed share of the rent and the sum Ordered takes into account a payment of $190.00 made by him today.
- The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy.
- The landlord does not agree that Mr Coleman should be released from liability for the arrears, even though he has continued to pay his contribution to the rent. This is a joint and several tenancy so all the tenants are jointly and severally liable for all the tenancy obligations.
- It is however fair that the prejudice to Mr Coleman be limited by supressing his identifying details.

- At the end of the tenancy the tenants must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- End of tenancy photographs provided by the landlord show that the tenants did not leave the premises reasonably clean and tidy.
- The landlord has incurred costs of $414.00 to have a preliminary clean done, as proved by the invoice provided. That claim is reasonable and the landlord should be compensated.
- The evidence shows that the carpets require thorough cleaning. The landlord has provide a quote for that work to be done at a cost of $782.00. The work has been booked. The landlord should also be compensated for that cost.
- Because the landlord has succeeded with the claim I must reimburse the filing fee.
