Reasons

This application was scheduled to be heard by video conference. The tenants did not connect to the Teams link provided to them and nor did they connect via telephone as instructed in the Notice of Hearing sent to them. The hearing proceeded in their absence.
I note that this application was made more than 2 months after the tenancy ended. In accordance with the provisions of s91A(2) of the Residential Tenancies Act 1986 special provisions apply in terms of service of all documents related to the hearing. However, I am accepting the email addresses as the addresses for service because it was noted as such in the tenancy agreements with both tenants. All documents have been sent to the email addresses.
The landlord has applied for rent arrears, compensation, payment of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy ended on 23 December 2024. The landlord made an application (5107710) for rent arrears and a hearing was scheduled to hear that matter on 13 February 2025. The landlord did not attend that hearing and so their application was dismissed.
This means that the claim for rent arrears has already been heard and determined and the landlord cannot then make another claim for the same thing.
The claim for rent arrears is therefore struck out.

Did the tenants comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The Photographs show that the tenants did not leave the premises reasonably clean, either inside or outside of the premises. There was also a small amount of rubbish that needed to be removed.
I also accept the evidence that the carpet needed deoderising and the curtains needed to be washed because there was a strong odour of dog in the premises.
I note that the landlord claimed $580.00 as the invoiced cost of cleaning the premises and tidying the outside.
This amount is not supported by the evidence and I have reduced the amount payable by the tenants for cleaning to $250.00
I accept the remaining invoices as being reasonable. Filing fee reimbursement
The landlord was substantially successful with this claim against the tenants and so I am requiring the tenants to reimburse them the filing fee. C ter Haar 12 March 2026
