Baylee Renee Haenga and Anna-Kate Rose Townsend must pay [The landlord/s] $8,234.93 immediately, calculated as shown in table below.

[The landlord/s] must take any of the tenant’s personal documents that have been left at the premises to the nearest Police station and obtain a receipt for them.
The landlord may dispose of the other goods left at the premises by the tenants as the landlord sees fit.

Reasons

The landlord attended the hearing. The tenants were properly served but they did not attend.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The landlord’s representative provided me with copies of emails and messages between her and the tenants. I can see there was an agreement the tenancy would end, and the tenants took longer than expected to move the last of their belongings. I find the tenancy ended on 5 January 2026, which is when the landlord took possession of the premises. The landlord provided rent records which prove the amount owing at the end of the tenancy.

Did the tenants comply with their obligations at the end of the tenancy?

Tenants must return the premises in a reasonably clean and tidy state and remove their rubbish at the end of the tenancy. Tenants are also required to keep the premises in a reasonably clean and tidy condition during the tenancy. See section 40(1)(c) and (e)(iii) Residential Tenancies Act (RTA).
The RTA does not require the premises to be in a spotless or an immaculate condition. The standard is based on what an average bystander would consider reasonable, not on the subjective opinions of the landlord and tenant. There is no scientific way to determine what is reasonably clean and tidy, and the Tribunal must evaluate the evidence available, and in particular inspection reports and photographs.
This is the landlord’s claim to prove. I have been provided with photos and invoices. I find the claims for the cost of removing rubbish in December and for carpet cleaning to be reasonable. These claims are proved and allowed.
The claim for cleaning was withdrawn because this has not been completed. The landlord will file a second application for the costs of cleaning up and for any damage.

Can the landlord remove the belongings and rubbish left by the tenants?

The landlord has applied for the disposal of goods the tenants left at the premises at the end of the tenancy. The landlord agreed on a period for the tenant was to collect the goods, but the tenants failed to collect the goods within that time.
It is not practicable for the landlord to the return the goods to the tenants. I have seen photos of all the goods. With the exception of the tools, I find the value of the goods is below the cost of storing, transporting and selling them. Therefore the landlord may dispose of the goods. See sections 62(3)(b), 62B(2) and (3) RTA.
The landlord should carefully check the drawer of tools to ensure there is nothing of value. If there are tools of value then the landlord should refer to the Tenancy Services website or seek advice. Other orders
Because the landlord has substantially succeeded with the claim I have reimbursed the filing fee.
The landlord’s application for suppression is allowed because the landlord is the most successful party. The tenants’ names will be published because there is public interest when tenants owe money at the end of a tenancy. See section 95A RTA.
