Reasons

The landlord attended the hearing.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond. This application came to me after an expedited application was declined.
The tenant is incarcerated and did not attend the hearing. He was properly served. I am satisfied he had plenty of time to get a message to the landlord if he wanted the tenancy to continue. Considering that the application is for termination because of an abandonment I find an order should be made.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986.
A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 26 November 2025 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The landlord became aware that someone else was living in the house when that person rang to say the tenant was incarcerated. There is only one tenant on the tenancy agreement. The landlord inspected on 17 November 2025 and the tenant was not at the house. The house was full of belongings.
The landlord asked for official confirmation that the tenant is incarcerated and received this by email on 26 November 2025. It seems most likely to me the landlord became aware there was an abandonment on that date.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing at the end of the tenancy.
The amount ordered includes one week of rent in lieu of notice. I can only allow rent in lieu of notice up to the date of hearing. The landlord can make a claim for the other two weeks.
Because the landlord has substantially succeeded with the claim I have reimbursed the filing fee.
The balance of the bond should be held pending the landlord’s second application.
