Rowina Selesa Lavasii, Saofaiga Lavasii, Herman Leuta, Jesse Setu Leuta, Jack Vaefa Lavasii and Lesina Lavasii owes [The landlord/s] $14,511.61 (“the debt”) as calculated in the table below:

Rowina Selesa Lavasii, Saofaiga Lavasii, Herman Leuta, Jesse Setu Leuta, Jack Vaefa Lavasii and Lesina Lavasii must pay [The landlord/s] $15,711.61, on or before Sunday 18 January 2026 being $1,200.00 for rent and $14,511.61 for the debt.
The payment will be allocated in the following order: rent, rent arrears, water rates arrears and then the filing fee.
If the tenant fails to pay rent and rent arrears within 2 working days of the due dates:
The tenancy at 42B Evans Road, Weymouth, Auckland 2103 will terminate and the landlord will have immediate possession of the premises.
The balance of the debt will be payable immediately.
If the tenant fails to pay the water rates arrears or the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

Reasons

Both parties attended the hearing.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
The applicant has provided a rent summary showing the amount owing to Friday 9 January 2026. I have added 9 days rent to reflect the amount owing to the 18 th of January 2026.
The tenant wants to repay the debt to avoid immediate termination. The applicant stated that they were happy to continue the tenancy if the debt was cleared.
During the hearing I discussed with the respondent whether this tenancy was sustainable and in their best interests. The respondent was adamant that it was.
Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
The orders above strike an appropriate balance between affording the respondents an opportunity to resolve the matter and secure the tenancy through compliance, whilst providing finality, certainty, and a clear pathway forward should they fail to do so.
Because the applicant has been successful in their application I have awarded the filing fee and granted their request for suppression.
