How much is owed for rent?

The parties entered into a fixed term tenancy for a term from 20 December 2024 to 17 December 2026.
The parties agreed that the tenancy would end on 28 December 2025.
The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy.
The tenant has contacted the Tribunal to confirm that he does not dispute the rent owed and agrees to the bond being paid to the landlord.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission 1 .
Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent. 2
Photographs provided by the landlord show that during the tenancy the premises were damaged, with a very large stain on the upstairs living room carpet and by a large burn on the wooden flooring in the kitchen.
The landlord has provided an invoice showing that the repair cost was: Carpet replacement - $632.50 Flooring replacement - $1,092.50.
The landlord seeks compensation for those costs. 1 S.40(2)(a), 41 and 49B RTA. 2 S.49B(3)(a) RTA.
I am satisfied that the damage occurred during the tenancy and was more than fair wear and tear. The landlord is entitled to be compensated for the loss caused. However, the agreement notes that the landlord has insurance under which the excess on a claim, where the damage is not deliberate, is $400.00.
There is no suggestion that the damage was intentionally caused, so the tenants’ liability is limited by s.49B(3) to the excess payable on a claim for each item of damage.
Because [The applicant/s] has substantially succeeded with the claim I have reimbursed the filing fee.
