At 10.07am 37 minutes after the hearing began the landlord received a text from the tenant saying that she had asked the Tribunal for an adjournment as she had slept through her alarm. The hearing started at 9.30am. I consider that the tenant was aware of today’s hearing and has not attended. I have proceeded in her absence.
The tenant has not proven her claim, and it is dismissed.
The landlord has told me that the tenant vacated the property yesterday. I am satisfied that the tenancy has ended. I have made a possession order in favour of the landlord to reflect that the landlord is entitled to possession.

The landlord tells me that the tenant damaged the laminate bench top by placing something hot on it that ‘burnt’ through the bench top. The tenant has tried to repair the laminate, but the repair is not satisfactory.
The landlord provided me with a copy of a quote for the replacement benchtop. It is slightly more that the cost of the insurance excess. I am satisfied that the tenant carelessly damaged the benchtop and that the amount the tenant is liable for is the insurance excess. Name suppression and filing fee.
The landlord has been successful in its application, I grant it name suppression and the filing fee as requested.
