Reasons
- The landlord attended the hearing which was conducted via videolink. There was no appearance for the tenant.
- The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
- On 10 November 2025 the parties attended a mediation. It was agreed that the tenancy would end on 24 November 2025 and the rent arrears owing would be $1,357.86. The tenants agreed to pay $1,385.86, including the filing fee of $28.00 from the bond of $1,840.00.
- The tenants also agreed to pay the current rent of $460 per week for the remaining two weeks of the tenancy.
- On that basis, it was probably not correct to try to calculate the rent arrears at 24 November 2025, given it was expected that the tenants would continue to pay the rent. One payment of $460.00 was made on 13 November, but no further rent payments were made
- According to the rent summary provided at today’s hearing, in fact the tenants would have owed $1,357.86 up to and including 10 November, not 24 November.
- Because the tenants paid rent for only one week of the remaining two weeks, the rent arrears owed at the end of the tenancy comes to $1,817.86. When the $1,357.86 rent arrears previously ordered, the balance of rent arrears for the period 11 November to 24 November is $460, which is the last week’s rent that was not paid. That is the amount ordered.
- Therefore this order incorporates the two totals of rent arrears, being $1,357.86 and $460 and the two filing fees.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy and remove all rubbish. See section 40(1)(e) Residential Tenancies Act 1986.
- The landlord provided copies of the entry and exit inspections. The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. The photos show items abandoned in the lounge, as well as in drawers, cupboards and wardrobes throughout the house. There appeared to have been no vacuuming or cleaning undertaken.
- The landlord provided an invoice for $790 which covered clearing up all the abandoned items and rubbish, tip fees and cleaning the property.
- The amounts ordered are proved.
- Because Oxygen.Co.Nz Ltd As Agent For M And T Patel has wholly succeeded with the claim I must reimburse the filing fee.
- The landlord did not seek name suppression.
