Reasons
- The hearing was conducted via video conference.
- Ms Steele, the property manager, attended the hearing via teleconference.
- Neither tenant attended the hearing, nor did they contact the Registry to explain their absence or seek an adjournment. I attempted to contact the tenants on the cell number ending in 5283 without success. The call went directly to voicemail, and the greeting appeared to be a recorded message in a child’s voice. The connection was then automatically cut off. Given the circumstances, the hearing proceeded in the tenants’ absence.
- The landlord has applied for rent arrears and has provided rent records which prove the amount owing.
- The parties signed a periodic tenancy agreement on or about 7 November 2025, with the tenancy commencing on 20 November 2025.
- On 18 November 2025, Ms Eru, one of the tenants, advised Ms Steele that they were no longer able to move in due to personal reasons. On that basis, 21 days’ notice to terminate the tenancy was given.
- The tenants did not pay the bond. The landlord is seeking rent arrears to cover the notice period under section 51(2A) of the Residential Tenancies Act 1986, which requires a tenant to terminate a periodic tenancy by giving at least 21 days’ notice.
- Accordingly, the tenants are liable for rent for the 21-day notice period. Filing fee
