[The tenant/s] must pay Kāinga Ora–Homes And Communities $4,861.19 (“the debt”) being rent arrears to 16 January 2024.
The Tenant shall pay the debt in instalments of $20.00 per week commencing Thursday 2 April 2026 until the debt is cleared.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The Tenant failed to leave the premises in a reasonably clean and tidy condition and did not remove all rubbish. The Landlord provided photographic evidence demonstrating that the property was left unclean, including images of a dirty oven and a substantial amount of rubbish remaining outside. Work orders were also submitted in support of the claim.
The Tenant submitted that they were required to vacate the property suddenly due to an emergency situation and did not have sufficient time to clean before departing. They also disputed responsibility for the rubbish, stating that they vacated the property on or about 17 January 2024, whereas the exit inspection photographs were taken on 15 January 2024. They also submitted their tenancy manager allowed them to leave some of the rubbish behind.
Having considered the evidence, I find it more likely than not that the Tenant failed to leave the property in a clean condition and did not remove all rubbish. This finding is supported by the vacate inspection report provided by the Landlord, which identifies the cleaning and rubbish removal required. The report records an inspection period commencing on 15 January 2024 and concluding on 17 January 2024. I am therefore satisfied that the report is current and reliable. The Tenant has not provided sufficient evidence to dispute the Landlord’s claim.
The amounts ordered are proved.
The Tenant has requested name suppression and this has been granted due to the circumstances surrounding the Tenants departure from the property which require confidentiality.
