The landlord attended the hearing via video conference. The tenant did not appear. The notice of hearing was sent to the tenant on 3 March 2026 and reminders about the hearing were sent on 5 and 9 March 2026.I am satisfied that the tenant had notice of the hearing and it continued in their absence.

The tenant had filed a cross application. They did not appear, and this application is dismissed.

The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent and water rates?

The tenancy was for a fixed term starting on 10 September and ending on 9 September 2026.This was recorded in the signed tenancy agreement provided by the landlord.

The landlord sought rent owing to the date of the hearing as and they did not consent to the tenant being released for the fixed term tenancy agreement and despite advertising no new tenancy had started.

The landlord has a duty to mitigate their losses when a tenant leaves a fixed term tenancy, this means they must take reasonable steps to reduce the financial loss caused by the tenants’ departure. Where any party to a tenancy agreement breaches any of the provisions of the agreement or of this Act, the other party shall take all reasonable steps to limit the damage or loss arising from that breach, in accordance with the rules of law relating to mitigation of loss or damage upon breach of contract. See section 49 RTA

The landlord has provided an invoice for advertising via myRent Ltd which uses Facebook and trade me. The landlord said that there have been viewings, but no one interested as many seem to want all the costs included and there are a lot of houses to rent and buy at the moment.

The landlord also raised that the reason the tenant left was for work reasons, and they were only 3 months into a 12 month fixed term. The landlord would not have offered the premises to the tenant if they thought it was for a short time period.

Correspondence provided supporting the landlords claim that the tenant was not released and that they were held liable for rent.

I find that the landlord has taken reasonable steps to mitigate their losses. Up to date rent records were provided and rent arrears are awarded to the hearing date.

The premises has individual check metres to measure water and electricity use. Photographs of the metre readings were provided.

A tenant is liable for the cost of outgoings that are exclusively attributable to their use of the premises. See section 39 Residential Tenancies Act 1986. This includes electricity, internet and supply of water on the basis of consumption.

Copies of water rates invoices and electricity accounts issued from the local authority for the period of the tenancy were provided.

The costs claimed for water use and electricity are awarded as the amount used by the tenant can be quantified.

The landlord said there was a verbal agreement that the tenant would pay half the cost of the internet use as the tenant used her plan and she shared her password with him. There is no evidence that the tenant agreed to be charged this cost. It was not noted in the tenancy agreement, and no correspondence between the parties supporting this was provided . The claim for reimbursement for internet use is dismissed.

The landlord claimed for the costs to advertise the premises. This claim was not made in the application filed on 8 December 2025 .The tenant left on 13 December 2025 and there is no evidence that the application was updated to include this claim. The tenant has not received notice of this claim, and it is dismissed.
