Reasons
- Only the applicant landlord attended the hearing. Neither tenant joined the video meeting and neither could be contacted by telephone.
- The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.
Should the tenancy be terminated?
- The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
- Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
- The tenant has breached their obligations by failing to pay the rent as required, smoking inside the premises and causing unreasonable disturbance to the neighbours.
- The landlord served the most recent 14-day notice on the tenant on 22 December 2025 with respect to rent arrears, and the tenant did not remedy the breach within the required period. Since that time further breach notices have been issued for anti-social behaviour.
- It would be inequitable to refuse to terminate the tenancy because of the persistent nature of the rent breaches alone. The rent has been constantly in arrears since February 2025 despite the landlord’s repeated requests for the breaches to be rectified.

- The landlord has provided rent records which prove the amount owing.
When is the tenancy to end?
- The request for immediate termination is approved because it would be unfair to refuse that request considering the numerous and ongoing breaches that continue to occur at the property and the tenants’ decision not to appear at the hearing to respond to the claims against them.
- As it is likely a further claim for compensation will be made the bond centre is to hold the balance of the bond.
- Because Wolfbrook Property Management Limited As Agent For Quantum 2020 - Alana Cammock has wholly succeeded with the claim I must reimburse the filing fee.
