The hearing proceeded by way of video conference. The landlords appeared. The tenant failed to appear. The Tribunal was satisfied the tenant was properly served with the notice of hearing (via their email address for service recorded on the bond lodgement form) and the case proceeded in their absence.

At the commencement of the hearing the landlord withdrew their claim for compensation for damage to the exterior weatherboards after successfully claiming insurance for their repair.

Invoices and dump fee receipts were provided to prove the amount claimed.

The Tribunal heard the property was provided in a clean and tidy condition free from rubbish. The landlord produced two videos, taken just prior to the commencement of the tenancy, which evidence this.

The landlords produced end of tenancy photographs which showed: a. The tenants had failed to undertake any cleaning at the property following the end of the tenancy. The floors had not been vacuumed to mopped, the cupboards had not been wiped out, the surfaces had not been wiped down, the oven was dirty and the bathroom had not been cleaned. b. The tenants failed to remove all of their belongings and rubbish from the property. There were at least three mattresses, an old sofa, a bookcase, chairs, kitchen equipment, clothing and footwear, cleaning products, broken toys, and other rubbish left inside the property and the garage. The landlords said food had been left to rot in the microwave. Receipts show the landlord dumped 780kg of rubbish and furniture left behind by the tenants. This did not include items the landlords were able to give away. 5415000 3 c. The landlords gave oral evidence that the carpets needed to be professionally cleaned due to an unpleasant odour throughout the property and very large stain in the lounge.

The Tribunal was able to make a proper before and after comparison of the condition of the property at the beginning and end of the tenancy. Having heard from the landlords and considering all of the evidence the Tribunal is satisfied the tenants failed to return the property in a reasonably clean and tidy condition free from rubbish. The Tribunal accepts the landlord’s oral evidence that the carpet required professional cleaning and stain treatment due to an offensive odour and stain.

The amounts ordered are proved. Other matters

The remaining bond held at the Bond Centre is refunded to the landlord.

Because [The landlord/s], [The landlord/s] have wholly succeeded with the claim I must reimburse the filing fee.

Despite being wholly successful the landlords did not seek name suppression.
