Reasons

Only the landlord attended today’s hearing. The tenant was called twice on the phone number in the application. Neither call was answered. The tenant did not attend by video or call into the hearing. I am satisfied that the tenant was given notice of today’s hearing and therefore have proceeded in her absence.
This was a 2.5 year tenancy. At the beginning of the tenancy the premises were brand new. The tenant gave notice to end her tenancy. 5415748 2
The landlord has applied for compensation for cleaning, rubbish removal and repair work after the tenancy ended.
The landlord completed a vacate inspection on the 5 November 2025, the day that the tenancy ended. A copy of the report was provided to the Tribunal. The photographs speak for themselves, the property has been left in poor condition, there is a considerable amount of rubbish left both in and around the tenancy premises, the tenant has simply taken what she wanted and left everything else including large items of furniture such as bed bases behind. Almost every wall in the house has holes or gouges in it, and there is evidence that the tenant has attempted to patch and repair previous holes.

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. .
The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish.
The landlord sought costs of cleaning the whole house as well as cleaning the oven, rangehood and kitchen cupboards. I am satisfied that all those areas needed cleaning.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
I am satisfied that there is considerable wall damage at this property. As noted above almost every wall had a hole, or patching on it. There were at least 13 holes that needed repair. Three of the holes were so large that the landlord had to replace the whole panel of gib. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.
