The landlord has applied for termination of the tenancy, rent arrears, compensation, refund of the bond, and reimbursement of the filing fee.

Should the tenancy be terminated?

The landlord applied for termination under section 56 of the Residential Tenancies Act 1986 (RTA). Section 56 is a general termination provision which allows the Tribunal to order a termination of the tenancy when: a. There has been a breach of an obligation under the tenancy agreement or RTA; and b. If the breach is capable of remedy, a notice has been given requiring the other party to remedy the breach within 14 days, and the party fails to do so; and c. The breach is of such a nature, or such an extent that it would be inequitable to refuse termination.
The landlord did not provide evidence that a 14 day notice has been given to the tenant for rent arrears. Accordingly the landlord’s application for termination is dismissed.
