- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish and leave all chattels provided for their benefit.
- The tenant must not carelessly or intentionally damage the premises.
- A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.
- Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent (or four weeks' market rent in the case of a tenant paying income-related rent).
- Where the damage is careless and is not covered by the landlord's insurance, the tenant's liability is limited to four weeks' rent (or market rent).
- Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for. Cleaning, Rubbish and Garden
- The tenants did not leave the premises reasonably clean and tidy and did not remove their rubbish
- The garden was untidy, and some plants had been destroyed by the tenant’s dog. The dog had also damaged a section of irrigation pipe.
- The council bins were full and needed emptying and cleaning.
- As well as the pipe damage, a doorstopper was missing from the premises that needed replacing.
- The amounts awarded for these breaches were proved by the photographs and invoices for the costs incurred. Damage
- There was damage to the premises during the tenancy comprising damage to walls and a ceiling and to carpet in the garage, the master bedroom and the living area.
- The damage is beyond fair wear and tear and the tenants have not disproved liability for the damage.
- The damage to the carpet included burn marks, including burn marks seemingly caused by cigarettes. Smoking in the premises was not permitted.
- The amounts awarded for replacement carpet and repairs and painting were proved by the photographs and invoices for the costs incurred or estimated.
- The landlord was insured for the carpet damage subject to a $1,000 excess for each event. Each room subject to damage is treated as a separate event and so the compensation awarded to the landlords has been limited to $3,000. Filing Fee
