Order
- The tenancy of Yunlong Wan at Room Suite 425, 133 Beach Road, Auckland Central, Auckland 1010 ended by agreement on 20 February 2026, when a new tenant took over the fixed term tenancy from Saturday 21 February 2026.
- The Bond Centre is to pay the bond of $1,320.00 (BN-07645636) to Auckland City-Living Management Limited As Agent For Red Brick Holdings Limited immediately.
- Yunlong Wan must pay Auckland City-Living Management Limited As Agent For Red Brick Holdings Limited $2,756.51 immediately, calculated as shown in the table below:
Reasons
- The landlord attended the hearing. The tenant did not.
- I am satisfied that the tenant had received proper notice of the hearing time, date and place and chose not to attend.
- The landlord has applied for termination of the fixed term tenancy which was due to end on 1 July 2026. The tenant, a student, gave notice to end the tenancy early and neither party have been able to get a tenant to take over the remainder of the fixed term lease. The landlord has confirmed a new tenant went into the premise from 21 February 2026.The tenancy therefore ended on 20 February 2026 by agreement. Therefore, it is seeking rent arrears, compensation, refund of the bond and reimbursement of the filing fee.
How much is owed for rent and electricity?
- The tenancy ended on 20 February 2026. The landlord provided rent records which prove the amount owing at the end of the tenancy. The tenant has not disproven these records. The tenant has not disproven these records.
- The landlord has also provided electricity records which prove the amount owing to 23 January 2026.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
- The landlord has provided evidence the premise was not left reasonably clean and tidy at the end of the tenancy and has proven the amounts ordered were necessary to clean the premise to a reasonably clean and tidy standard. Reimbursement of filing fee
- Section 102(4) of the RTA confirms that applicants that are wholly or substantially successful in proving their claims will have their filing fee reimbursed.
- Because Auckland City-Living Management Limited As Agent For Red Brick Holdings Limited has wholly succeeded with the claim I must reimburse the filing fee.
