Reasons

The landlord attended the hearing by video call. The tenants did not connect to the remote hearing. The tenants were telephoned on the phone numbers provided but the phone calls went unanswered. I am satisfied the tenants were properly served with notice of the hearing. The hearing proceeded in their absence.

The landlord has applied for termination of the tenancy, rent arrears and water rates, compensation and reimbursement of the filing fee.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. 1

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The tenant breached their obligations by failing to pay the rent as and when it is due and payable under the tenancy agreement. 2

The landlord served a notice to remedy a breach on the tenant on 7 January 2026 for rent arrears. The tenant did not remedy the breach. Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy. 3

As I have terminated the tenancy for rent arrears, I do not need to consider the claim for termination for a breach in respect of cleaning and damage. The landlord withdrew the claim for compensation and will file a further application one final amounts claimed for compensation are known.

The termination date reflects that there is the easter holiday period between 3-6 April 2026.

How much is owed for rent?

The application form did not include a claim for the bond; therefore, the bond remains at the bond centre.

Because the landlord has succeeded with the claim, I must reimburse the filing fee.

The landlord sought suppression and as the application is successful, I have made an order accordingly. 6
