Is the respondent liable for the cleaning and rubbish removal costs?
- The applicant has provided photographs from the end of the tenancy showing that the property was left well short of the standard required by section 40(1)(e)(iii), which requires a tenant to leave the premises in a reasonably clean and tidy condition and to remove all their rubbish.
- There is a significant amount of belongings and rubbish left inside and outside the property and the property has not been cleaned.
- I am satisfied that these costs were reasonably incurred as a result of the respondent’s breach of section 40.
- The cleaning and rubbish removal costs are awarded.
Is the respondent liable for the repair costs?
- The applicant has provided photographs showing two holes in a wall. I am satisfied that this damage was caused either carelessly or intentionally by the respondent in breach of section 40(2)(a). This is because the damage appears to have resulted from impact, and the tenant has attempted to conceal or remedy it by placing tape over the holes.
- I am satisfied that the repair cost of $80.32 is reasonable and is awarded
