Reasons
- Both parties attended the hearing. Mr Odedra represented the landlord.
- The landlord has applied for rent arrears, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
- The parties agreed that the tenancy can be terminated. However, the date the tenancy should end (and the date the obligation to pay rent should cease) was in dispute.
- Mr Chandra vacated the property in or about January 2025 because he was unable to continue to pay rent. The tenancy was a fixed term tenancy expiring on 30 September 2026. This means that the tenancy cannot be ended by notice. However, Mr Chandra claims that Mr Odedra agreed to terminate the tenancy around the time he vacated. Mr Odedra disputes that there was any such agreement.
- I am not satisfied that Mr Chandra has provided sufficient evidence to support that Mr Odedra did agree to end the tenancy in January and did agree to release Mr Chandra from his obligation to pay rent after that date.
- I therefore find Mr Chandra liable to pay rent up until today’s date.
- The amount of rent owing to today’s date has been established by the production of a rent record.
- The landlord has been successful in its claims and is therefore entitled to payment of the Tribunal application fee.
