Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy and remove all rubbish. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The landlord provided photographic evidence that tenant did not leave the premises reasonably clean and tidy, did not remove all rubbish and that the carpet was stained.

The landlord also provided evidence that the premises were clear of methamphetamine at the start of the tenancy but were contaminated with levels exceeding 15μg/100cm2 at the end of the tenancy. The landlord provided evidence that after cleaning, the methamphetamine levels were once again below 15μg/100cm2.

The landlord provided a detailed spreadsheet of the hours and costs involved in their completing all of the required work. Having regard to invoices which the Tribunal regularly sees for work of this nature and scope, the Tribunal has awarded sums which are fair and just.

The amounts ordered are proved. Compensation for lost rent

The landlord claimed compensation for loss of rent due to the period it took to restore the property to a sufficiently clean and tidy condition so that it could be rented.

A landlord can be expected to have a period of vacancy between tenancies where no rent is earned. However, it is appropriate for a tenant to compensate a landlord where they have left the property in such a state that it could not be let out and it takes a longer period for the landlord to get the property up to the necessary standard. Such loss is reasonably foreseeable where a tenant walks away from a property leaving it in a filthy state and burdened with a substantial amount of rubbish.

The landlord has persuaded the Tribunal that in this particular case, it is appropriate to award compensation for the delay caused by the tenant’s failure to clear and clean the property. A sum of two weeks’ rental is awarded. Exemplary damages for the tenant failing to allow the landlord access

The landlord provided evidence that they had given notice on 26 December 2025 of an inspection to take place on 28 December 2025. The landlord advised that upon arriving at the property the tenant was not there. The landlord provided photographic evidence of the steps the tenant had taken to deny the landlord access by tying up the two doors with bungy cords.

However, the landlord did obtain access. The tenant was therefore unsuccessful in denying the landlord access.
