Order
- Rona Taverio, Moeroa Taverio and George Hererahi owe Gg Blue Enterprises Limited As Agent For Balraj Singh $3,423.63 (“the debt”).
- Rona Taverio, Moeroa Taverio and George Hererahi must pay rent and the debt as follows: a. By making weekly payments of $1,620.00, being $1,420.00 for rent and $200.00 for the debt. b. Payments will be every Thursday , with the first payment on Thursday 26 February 2026 and continuing until the whole of the debt is cleared .
- Payments will be allocated in the following order: rent, rent arrears, water rates and the filing fee.
- If the tenants fail to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 12 Dolphin Street, Pakuranga, Auckland 2010 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
- If the tenants fail to pay the water rates and filing fee within 2 working days of the due date, the filing fee will be payable immediately.
Reasons
- Both parties attended the hearing which was held remotely. Rona Taverio advised that she represented all tenants at today’s hearing.
- The landlord has applied for termination of the tenancy, rent arrears, water rates, reimbursement of the filing fee and payment of the bond.
- The tenants want to repay the debt to avoid immediate termination.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- After discussion at today’s hearing, I am satisfied the tenants will pay the debt within the period specified in the order and are unlikely to commit any further relevant breach. I have therefore granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
- Please note that I have assessed the rent arrears as at 25 February 2026, the date before the repayments begin.
- I am also requiring the tenants to reimburse the filing fee to the landlord because the landlord was wholly successful with this claim. C ter Haar 19 February 2026
