- David Otter must pay Tbt Property Management Limited As Agent For Dev Paul Dhingra $1,528.00 immediately, calculated as shown in the table below:
- The Bond Centre is to pay the bond of $2,900.00 (BN-00108381) to Tbt Property Management Limited As Agent For Dev Paul Dhingra immediately.
- All other claims are dismissed.
Reasons
- Mr Singh, representing the landlord, attended the video conference hearing. The tenant did not join the hearing conference as per the instructions in the Notice of Hearing and so did not attend the hearing. As the tenant was served, the hearing proceeded in his absence.
- Whilst another tenant was named in the tenancy agreement, Mr Otter confirmed in a Mediator’s order dated 24 November 2025, sealed on 25 November 2025 in application 5371807, that the other tenant had left the property, and Mr Otter agreed to assume sole responsibility for any tenancy debt. Given this, I accept the other tenant likely left the tenancy and does not need to be named in or served with this application.
- The landlord has applied for termination of the tenancy, rent arrears, outgoings, refund of the bond and reimbursement of the filing fee.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
How much is owing for rent and water?
- There is a Mediator’s Order dated 24 November 2025, sealed on 25 November 2025 in application 5371807, which dealt with rent arrears up to 26 November 2025. As such, I will only consider rent arrears owing from 27 November 2025 to the end of the tenancy in this order.
- The landlord provided rent records which prove the amount owing from 27 November 2025 until 12 March 2026, which is the end of the tenancy, is $4,400.00.
- The landlord claimed $850.32 for water bills to 12 February 2026.
- The landlord provided a water ledger, which also included 2 sets of Tribunal application filing fees, so did not only deal with water. The ledger provided did not show any zero balance owing during the tenancy. The landlord provided 4 water invoices for the periods 8 July 2025 to 8 August 2025, from 8 August 2025 to 8 September 2025, from 8 September 2025 to 7 October 2025 and one for the period 7 October 2025 to 10 November 2025. Unfortunately, the water invoice provided for the period 7 October 2025 to 10 November 2025 relates to a different address from the tenancy so I cannot consider this water invoice. Further, the other 3 water invoices provided do not cover all the water bills invoiced to the tenant in the landlord’s ledger, as there were at least 3 water invoices in the ledger that were not provided as evidence by the landlord, in addition to the incorrect address water invoice for the period 7 October 2025 to 10 November 2025 being provided. As such, I find the landlord has provided insufficient evidence to prove their claim for water bills and so dismiss this claim. Filing fee
- Because Tbt Property Management Limited As Agent For Dev Paul Dhingra has been mostly successful with the claim I reimburse the filing fee. Refund of the bond
