Reasons

The landlord attended the hearing, set down to be conducted via video conference. There was no entry into the conference by the tenant, nor any call in to the conference by one of the telephone numbers provided on the Notice of Hearing. I was satisfied adequate service had completed and I continued with the hearing.

The landlord has applied for termination of the tenancy for breach of the tenant’s obligations and orders for rent arrears, water rates and the filing fee.

The landlord provided updated rent and water summaries prior to the hearing.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The tenant has breached their obligations by failing to pay rent and water as due or remedying once formally advised of this.

The landlord served a 14-day notice on the tenant on 2 December 2025 for both rent arrears and outstanding water rates, and the tenant did not remedy the breach within the required period.

It would be inequitable to refuse to terminate the tenancy because the tenant has failed to remedy the situation since the December notice. Further, an informal repayment schedule was agreed between the parties early this year but that failed after a few weeks. That reduced any confidence I might have for an alternative conditional termination order at this time as being reasonable or realistic. The landlord stated a colleague had recently spoken to the tenant who advised she was unable to maintain the repayments and rent as due. Filing fee
