Reasons

The landlord attended the hearing which was held by videoconference.

The tenants didn’t attend and couldn’t be reached on the phone number given in the Notice of Hearing, which was properly served.

The Hearing weas scheduled to begin at 3:15pm today. At 2:42pm Mr Seluini e- mailed, “I am writing urgently as I have only just received an email today regarding a tribunal hearing scheduled for 3:15pm. Unfortunately, I am currently at work with a busy schedule at that time and will not be able to attend the hearing on such short notice. Additionally, I have not received any prior communication outlining the details or reason for this tribunal hearing....” An adjournment was requested.

It appears from the file that the following messages were sent to the tenants, to the e-mail addresses for service given in the agreement (the same e-mail address as Mr Seluini e-mailed from today) and by SMS to the phone number given in the agreement: a. 5 January – notice that an application had been filed; b. 28 January - notice of a mediation scheduled for 10 February 2026, which the property manager says Mr Seluini attended; c. 5 February 2026 – reminder of the mediation; d. 9 February – reminder of the mediation; e. 11 February - notice of today’s videoconference hearing; f. 18 March – reminder for the hearing; g. 22 March – reminder for the hearing.

That indicates that ample opportunity has been given to the tenants about today’s hearing, before yesterday’s e-mail and SMS reminder, to make arrangements to obtain any information necessary to prepare and to attend.

In those circumstances I find that it would be unfair to the landlord not to proceed today.

The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The tenant has breached their obligations by failing to pay for water used at the premises and failing to pay rent when due.

The landlord served a series of 14-day notices on the tenant for overdue rent and requiring rent to be paid when due. Rent records provided by the landlord show that those notice were not complied with and rent has been in arrears since 25 January, increasing at one point to 3 weeks’ in arrears.

That, and the tenants’ failure to pay for water used at the premises, persuade me that it would be inequitable to the landlord to refuse to terminate the tenancy.

Because [The applicant/s] has succeeded with the claim I must reimburse the filing fee.
