- The landlord attended the hearing which was held by videoconference. The tenants did not attend. Two calls were made to each of the tenants on the numbers given in the Notice of Hearing, which was properly served. All calls went to answerphone.
- The landlord has applied for rent arrears, compensation and reimbursement of the filing fee following the end of the tenancy. The bond has been paid to the landlord.
How much is owed for rent and water rates?
- The tenancy ended on 8 December 2025.
- The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy. I have reduced the sum awarded for water rates to ensure that the tenants are only paying the consumption charges.
Did the tenants comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- Exit inspection photographs provided by the landlord show that when the tenants vacated a significant quantity of rubbish was left that the landlord needed to dispose of.
- The landlord claims the cost for a skip bin hire and the dump fees. Those costs are reasonable and are proved by the invoices provided. That landlord should be compensated for those losses.
- The tenant has made some payments after the tenancy ended, which are allowed for in the Order.
- Because the landlord has succeeded with the claim I must reimburse the filing fee.
