Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.

The Landlord submitted the tenant did not remove the rubbish in the yellow bin and as a result the Landlord had to organise disposal of it. An invoice was provided for the dump fees and a photograph of the sticker from the Council advising the rubbish could not be removed because it had incorrect rubbish in it. The Tenant agreed there was rubbish left behind in the bin however the Landlord did not give the Tenant an opportunity to remedy it. They were not aware that bin was not collected because it had the wrong rubbish in it.

In considering the evidence, it is the Tenants responsibility to ensure the property is left behind in a reasonably clean and tidy state. This includes removal of all rubbish. The Landlord is not obliged to provide the Tenants with an opportunity to remove the rubbish so this should have been completed before the Tenants moved out.

The amounts ordered are proved.

The Landlord claimed the Tenants did not leave the lawns and garden in a reasonably clean and tidy state. There were weeds present and grass that required mowing. A photograph of the garden at the end of the tenancy was provided confirming there were weeds and overgrown grass. There was also an invoice for the gardening.

The Tenants submitted that the weeds were removed as they recall hiring a weed wacker on 10 November 2025 before they moved out on 30 November 2025. The garden and weeds would have grown back somewhat however it would be unreasonable for the Landlord to expect the Tenants, who were students, to hire gardening equipment every 2-3 weeks to maintain the garden.

In considering the evidence, I find the lawns required mowing and removal of weeds from the photograph provided. The Tenants could have mowed the lawns just prior to moving out to overcome the growth that occurred by the end of the tenancy.

The amounts ordered are proved.

As the Landlord has been wholly successful with their application, name suppression is granted to the Landlord and the Tenants shall reimburse the filing fee. As the Tenants have not been successful, name suppression is not granted to the Tenants.
