The Bond Centre is to pay the bond of $1,080.00 ([Bond number suppressed]) to [The landlord/s] immediately.

Reasons

This application was scheduled to be heard by video conference. The tenant did not connect to the Teams link or ring in to the hearing as she is required to do, should she not be able to connect to the Teams link. The hearing proceeded in her absence.
The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
The tenant has breached their obligations by failing to pay rent as and when it fell due.
The landlord served 14-day notices on the tenant on 15 December 2025, 30 December 2025 and 19 January 2026. The tenant did not remedy the breaches within the required periods.
It would be inequitable to refuse to terminate the tenancy because: (a) The tenant has been in significant arrears and has made sporadic payments from the beginning of 2025; and (b) The tenant has not communicated with the landlord about the arrears; and (c) The tenant did not attend today’s hearing and so no arrangement could be made in terms of a repayment plan.
I also note that the tenant has not paid her water rates.

I accept the rent record which shows that as at today’s date the tenant owes $1,100.00 in rent. This includes a payment of $1,100.00 made yesterday.
I also accept the evidence showing that the tenant owes $392.91 in outstanding water rates.
Further to this, I am ordering the tenant to reimburse the filing fee to the landlord because the landlord was wholly successful with this claim against her. Suppression of name
