Reasons
- The landlord attended the hearing, set down to be conducted via video conference. There was no entry into the conference by the tenant, nor any call in to the conference by one of the telephone numbers provided on the Notice of Hearing. I was satisfied adequate service had completed and I continued with the hearing.
- The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
How much is owed for rent?
- The tenancy ended on 22 December 2025 after the landlord released the tenants early from a fixed-term tenancy. The landlord provided rent records which prove the amount owing at the end of the tenancy is as ordered.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
- The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish.
- One tenant was involved in a previous tenancy and raised valid concerns regarding previous items left at the premises (in emails to the landlord as provided). Having carefully reviewed the exit photos and historic photos I am satisfied the landlord has accounted for pre-tenancy items separately and the invoice provided aligns with the items and rubbish evidence in the exit photos.
- In related emails, the tenant also argues the condition at the end of the tenancy was reasonable clean and tidy. Such assessment as to reasonableness is a frequent task of the Tribunal and I am more than satisfied that the premises required further cleaning to get it to a reasonable state as expected of an exiting tenant. This conclusion was based on the photos provided and a review of the invoice for $724.50 (being the invoice for both cleaning and removal).
- The amounts ordered are proved. Filing fee
- Because Oxygen.Co.Nz Limited As Agent For Marysia Bogusz has wholly succeeded with the claim I must reimburse the filing fee.
