Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The evidence produced shows that further cleaning was required for the premises to be reasonably clean. The cleaning required was vacuuming and cleaning of the kitchen splashback.
- The tenant submitted that the unit had been vacuumed at the end of the tenancy and it was not possible to vacuum in all the corners. While the tenant may have vacuumed I have reached the conclusion that further cleaning was required.
- The landlord has claimed for repairs to the walls in the living room and second bedroom and replacement of the silicone in the kitchen.
- There are two small holes that require repair and the silicone is mouldy. On the evidence submitted I accept that this damage occurred during this tenancy and required repairing.
- The amounts ordered are proved.
- Because Inspire Real Estate Limited As Agent For William Young And Elise Yule / Egy Way Trus has wholly succeeded with the claim I must reimburse the filing fee.
