The tenancy of [Tenant 1], [Tenant 2], [Tenant 3] at 21 Adel Place, Weymouth, Auckland 2103 is terminated, and possession is granted to Tbt Property Management Limited, at 6.00pm on Thursday 4 June 2026, subject to the following conditions: a. [The tenant/s] must pay rent and the debt by payments of $1000.00, being $750 for rent and $250 for the debt on or before i. Friday 15 May 2026 and ii. Friday 22 May 2026 and iii. Friday 29 May 2026, a. Payments will be allocated in the following order: rent, rent arrears, water rates and the filing fee. b. If the tenant fails to pay the payments set out at order 6. a. (above) the tenancy at 21 Adel Place, Weymouth, Auckland 2103 will terminate, and the landlord will have immediate possession of the premises.

The landlord attended the hearing remotely.
[Tenant 1[, and [Tenant 3] attended the hearing by phone.
[Tenant 2] did not attend the hearing. She was phoned on the phone number provided but the phone call went to voice mail. During the hearing she contacted the MOJ call centre to be phoned for the hearing, however I did not receive this message until after the hearing. [Tenant 1] said she had authority to act for [Tenant 2] in any event.
The landlord has applied for: a. termination of the tenancy, b. rent arrears, c. water rates, d. payment of the bond, and e. reimbursement of the filing fee. Termination
The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. 1 Where the breach is capable of remedy the landlord must first serve a notice on the tenant 1 See section 56(1) RTA. requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so. The tenant breached their obligations by failing to pay the rent as and when it is due and payable under the tenancy agreement. 2 The landlord served notice to remedy a breach on the tenant on 14 January 2026. The tenant did not remedy the breach. Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy. 3

By consent I have delayed the termination date, however there is an additional conditional termination clause as the tenant requested time to vacate the premises and the landlord agreed to this on the basis the rent is paid each week and the tenant makes payments towards the rent arrears. If the tenant does not pay her rent and the agreed additional payment towards the rent arrears then the tenancy will terminate immediately and the landlord will be entitled to possession. 4 Rent arrears
The landlord provided rent records which prove the amount owing to 14 May 2026. Rent to the termination date is $8,450. I have made an order for rent arrears to the hearing date as the tenants may give notice to terminate the tenancy earlier in which case the tenant’s final rent liability may decrease.
On 20 February 2025 and 18 November 2025 the Tribunal made orders relating to this tenancy, for rent arrears, water rates and conditional termination orders. The order set out above for rent arrears and water rates replaces the previous orders for rent arrears and water rates. The filing fees that the tenant agreed to pay in the previous orders are incorporated into this order for enforcement purposes. Water rates
The landlord provided a water rates statement, and the amount ordered for water rates is made by consent. I have deducted the two filing fees referred to above that were recorded in the tenancy invoices statement which said the total amount owing is $534.07. The amount ordered is $534.07 less $27 less $28.

The bond is to be paid to the landlord immediately to offset the amounts ordered. Filing fee
Because the landlord has wholly succeeded with the claim I must reimburse the filing fee. Liability
[Tenant 1] was the original tenant and her children [Tenant 2] and [Tenant 3] were added as tenants after this application was filed on 3 April 2026. The landlord did not provide a copy of the variation agreement and the landlord and [Tenant 1] agreed that [Tenant 2] and [Tenant 3] should not be liable for the amounts ordered. Accordingly [Tenant 1] is solely liable for the amounts ordered. Suppression
The Tribunal must, on the application of a party that has wholly or substantially succeeded in proceedings, order that the party’s name or identifying particulars not be published, unless the Tribunal considers that publication is in the public interest or is justified because of the party’s conduct or any other circumstances of the case. 5
