Reasons
- Mr Cheung represented the landlord. The tenants did not attend the hearing. I held the hearing by video. I am satisfied that proper notice of the hearing was provided to the tenants.
- The landlord has applied for termination of the tenancy, rent arrears, water rates, reimbursement of the filing fee, and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated 1 .
- The landlord provided rent records which prove the amount of rent owing at the end of the current rent period (tomorrow). I have made the possession order to coincide with that.
- The landlord provided water rates invoices which prove the amount of water rates owing (less fixed charges).
- The Tribunal made an order for rent arrears and water rates on 8 January 2026 2 . Mr Cheung said that the tenants had paid the amount ordered in full.
- The current application is based on rent arrears that accrued after that order was made. Mr Cheung said that the landlord was prepared to negotiate a date with the tenants by which they must vacate the tenancy. They will remain liable for rent until they leave.
- As the application is successful, I have reimbursed the landlord the filing fee.
