- The tenant gave notice to end the tenancy, and the tenancy ended on 17 February 2026 as arranged in this notice. Therefore termination of the tenancy is no longer being sought.
- On the evidence of the landlord, I am satisfied the tenant understood the claims for rent arrears and water rates being made against her and has had sufficient opportunity to clarify these claims and confirm the hearing date, if she didn’t already know them. These are simple claims. If I am incorrect in this, the tenant has the opportunity to seek a rehearing.
- I am not prepared to allow other claims to be added to this application during this hearing as I am not satisfied on the balance of probabilities the tenant has received sufficient particulars of these claims. If further claims are sought regarding this tenancy, a new application will need to be filed.
- The tenancy ended on 17 February 2026. The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy was $4,860.00 for rent arrears and $203.29 for unpaid water rates.
- Because Summit Property Management Limited As Agent For Samantha Franklin & Cameron St John has substantially succeeded with the claim I have reimbursed the filing fee.
