The landlord attended the hearing which was held by videoconference. The tenant didn’t attend and couldn’t be reached on the phone number given in the Notice of Hearing, which was properly served, or on an alternative number provided by the property manager.
The landlord has applied for rent arrears, compensation, and reimbursement of the filing fee following the end of the tenancy. The bond has already been released to the landlord by agreement.

How much is owed for rent?

The tenancy was for a fixed term from 7 November 2025 to 7 January 2027. The tenant fell into arrears. The tenancy was ended by agreement. Rent is claimed by the landlord to the date the tenant vacated, which the landlord is entitled to.
The landlord provided rent records which prove the amount owing at the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
Exit inspection photographs provided by the landlord show that the tenant left the grounds of the premises very overgrown. A lot of rubbish was left behind that the landlord had to pay to have removed.
The landlord’s loss is proved by the invoice provided. Having considered the evidence showing the amount of work needed to tidy the grounds and remove the rubbish left, I am satisfied that the charges are reasonable and the landlord should be compensated.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
The exit inspection photographs show that during the tenancy the following damage was caused: a. trellis at the end of the deck was missing; b. glass in the rear door was broken; c. there was damage to wooden doors and door frames and holes in walls; d. nails and stickers needed to be removed; e. there were paint marks from spray painting done on the deck.
The evidence shows that damage was unlikely to be fair wear and tear and the tenant has not disproved liability for the damage.
The amounts paid by the landlord to have that damage repaired is proved by the invoices provided. The claims are reasonable and the landlord should be compensated.
Because [The applicant/s] has succeeded with the claim I must reimburse the filing fee.
