Reasons
- The landlord attended the hearing. The tenants did not connect to the MS Teams link provided to them and nor did they connect via telephone as instructed in the Notice of Hearing sent to them. The hearing proceeded in their absence.
- The landlord has applied for rent arrears, water rates, payment of the bond, and reimbursement of the filing fee following the end of the tenancy. Relevant legal considerations
- The relevant law that applies is found in the Residential Tenancies Act 1986 (RTA). With any claim before the Tenancy Tribunal, the Tribunal applies the usual civil law standards and expectations. That includes a requirement that the applicant establish their claims on the balance of probabilities.
How much is owed for rent?
- The tenant must pay the rent as and when it is due and payable under the tenancy agreement. 1 The tenancy ended on 2 September 2024. The landlord provided rent records which prove the amount owing at the end of the tenancy.
How much is owed for water rates?
- The tenant is responsible for water consumption charges. 2 The landlord provided water rates invoices.
- The landlord claimed $104.28 however after discussion at the hearing it was established that $29.85 of the claim related to water rates incurred after this tenancy ended and the landlord did not have a final mater reading in respect of the final claim for $42.58 so that claimed was withdrawn. The amount ordered is $31.85 for water rates to the end of the tenancy. Bond, filing fee and suppression
- The bond is to be paid to the landlord immediately to offset the amount’s ordered.
- Because the landlord has been partly successful in their claim, I have ordered that the tenant reimburse the filing fee. 3
- The landlord did not seek name suppression
