Reasons
- The landlord attended the hearing held remotely today. None of the tenants attended. I continued with the hearing as all tenants have been emailed notice of the hearing date and time to their addresses for service.
- The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.
Should the tenancy be terminated?
- The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
- On 21 January 2026, the landlord became aware (or ought to have been aware) that the tenants had abandoned the premises. The landlord discovered the premises were being used to grow marijuana on a large scale and the police had attended. Photographs from an inspection on that date show all rooms with large plant pots in them and an extensive irrigation system. The power had been disconnected and there were no personal belongings of furniture in the house.
- The landlord has sent several emails and made phone calls to the tenants but with no response.
- Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
How much do the tenants owe?
- The landlord provided rent records which prove the amount owing for rent to today’s date is $3,200.00. I award this amount.
- This is a fixed term tenancy, so the tenants are liable for rent until the end of the fixed term or until the date of commencement of a new tenancy, whichever is earlier; s61(3)(b) RTA. The landlord can apply for compensation for additional loss of rent once the amount of this is known.
- I also award the water rates owing and the filing fee and refund the bond to the landlord. No suppression orders apply.
