The tenant did not join the hearing by the video link or dial-in instructions provided in the Notice of Hearing. The tenant did not answer two calls I made to her mobile number during the hearing.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy ended on 15 January 2026. The landlord provided rent records which prove the amount owing at the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish.
The landlord provided photographs and receipts to support its claims. While the cleaning cost appeared to be high, I am satisfied that it was reasonable having regard to the photographs showing the property at the end of the tenancy.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent (or four weeks' market rent in the case of a tenant paying income-related rent). See section 49B(3)(a) RTA. 1 1 The Landlord did not provide evidence of insurance cover or excess and there did not appear to be any Insurance Statement in the Tenancy Agreement.
The following damage was caused during the tenancy: wall and curtain damage, carpets stained and soiled. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.
The landlord provided photographs and receipts to prove its claims. The amount claimed for carpet was $2,500. I have awarded $1,500 having regard to the age, condition and likely useful lifespan of the carpet. Exemplary Damages Claim
The landlord also claimed $400 exemplary damages for the tenant having a pet at the property. The landlord could not clearly explain that claim to me at the hearing.
Since December 2025 it has been an unlawful act for a tenant to keep a pet without a provision in the tenancy agreement or landlord’s consent to keep pet. See s42C(2) and s109 RTA. The maximum exemplary damages which may be awarded for an established breach is $750. See Sched 1A RTA.
There is some evidence that the tenant may have had a pet at the premises. It is unclear whether that occurred after s42C(2) came into effect. The landlord has not established that the tenant committed an unlawful act. Even if it had, I would not have awarded exemplary damages in this instance, having regard to the fact the tenancy ended shortly after s42C(2) came into force.
This aspect of the claim is dismissed.
As the landlord was partially successful, I have awarded reimbursement of the Tribunal application fee.
